Scenario 1: Gold Physically Kept at Home

For gold jewellery, coins or biscuits kept at home, the person who brings the gold to the branch and provides their Aadhaar is the seller on the receipt. A gold buyer does not verify joint ownership of physical gold - the legal division of proceeds between owners is between the parties, not the buyer.


Scenario 2: Gold in a Joint Bank Locker

Most banks require both locker holders present to open a joint locker, unless an 'either or survivor' clause was set up at the time of opening. If one holder is deceased, the bank requires a death certificate and succession documents per their policy.

Once the gold is physically removed from the locker, the gold buyer transaction is standard - Aadhaar + PAN.


Scenario 3: One Owner Is Abroad or Unavailable

  • Power of Attorney (POA): the absent owner can give a registered POA authorising the present owner to act for the gold sale
  • For physical gold at home: the person present can sell it - but the absent owner retains legal rights to their share of proceeds
  • For locker gold: the bank's rules govern access - check with your specific bank
  • If the absent person does not consent: do not sell their portion of jointly owned gold without consent


Tax: How Joint Gold Capital Gains Are Reported

If both owners are on record as holding the gold, each owner reports their proportionate share of the capital gain in their respective ITR. If only one owner's Aadhaar is on the receipt, that owner reports the full capital gain in their ITR and transfers the other party's share separately.
