Joint Gold Ownership: Who Needs to Sign When Selling?
Gold in India is frequently owned jointly - by spouses, parents and children, or siblings. When selling jointly held gold, questions arise: does both parties' consent need to be recorded? Who signs the receipt? What if one owner is abroad?
The answer depends on how the gold is held - physically at home, in a joint bank locker, or as a financial instrument.
At a Glance
| Gold kept physically at home | Person physically selling it signs the receipt |
|---|---|
| Joint bank locker gold | Bank protocols apply - often both holders needed to remove |
| Gold in joint demat | Demat instructions usually require joint consent |
| Tax implications | Each owner reports their share of capital gain |
| One owner abroad? | Power of attorney or physical presence options |

Scenario 1: Gold Physically Kept at Home
For gold jewellery, coins or biscuits kept at home, the person who brings the gold to the branch and provides their Aadhaar is the seller on the receipt. A gold buyer does not verify joint ownership of physical gold - the legal division of proceeds between owners is between the parties, not the buyer.
Scenario 2: Gold in a Joint Bank Locker
Most banks require both locker holders present to open a joint locker, unless an 'either or survivor' clause was set up at the time of opening. If one holder is deceased, the bank requires a death certificate and succession documents per their policy.
Once the gold is physically removed from the locker, the gold buyer transaction is standard - Aadhaar + PAN.
Scenario 3: One Owner Is Abroad or Unavailable
- Power of Attorney (POA): the absent owner can give a registered POA authorising the present owner to act for the gold sale
- For physical gold at home: the person present can sell it - but the absent owner retains legal rights to their share of proceeds
- For locker gold: the bank's rules govern access - check with your specific bank
- If the absent person does not consent: do not sell their portion of jointly owned gold without consent
Tax: How Joint Gold Capital Gains Are Reported
If both owners are on record as holding the gold, each owner reports their proportionate share of the capital gain in their respective ITR. If only one owner's Aadhaar is on the receipt, that owner reports the full capital gain in their ITR and transfers the other party's share separately.

Frequently Asked Questions
Does my spouse need to come to the branch when I sell our gold?
For physical gold at home, no. For joint bank locker gold, your bank's procedures govern.
Can I sell gold from a joint locker alone?
Only if your locker agreement has an 'either or survivor' clause. Check with your bank.
Who pays capital gains tax on jointly held gold?
Each owner reports their share proportionally. If only one person's name is on the receipt, that person reports the full gain.
What if my co-owner is deceased?
For physical gold, the living owner can sell with standard documents. For locker gold, bank requires death certificate and succession documentation.
Can I use a Power of Attorney to sell on behalf of a joint owner?
Yes - a registered POA authorising the gold sale can be used.
What if joint owners disagree on whether to sell?
A gold buyer cannot adjudicate ownership disputes. Both owners need to agree before selling.
Is the sale receipt in one name or both?
In the name of the person presenting their Aadhaar at the branch.
