Gold Found at Home or in a Safe: How to Prove Ownership & Sell Legally

You open an old almira, a family safe or a bank locker and find undocumented gold - inherited from a grandparent, accumulated over decades, or simply forgotten. Can you sell it? Is it legal? Will the income tax department ask questions?

Yes - you can sell undocumented gold. But how you handle the paperwork matters.

How Much Undeclared Gold Is Allowed?

CBDT guidelines provide exemption limits for household gold that cannot be seized during an income tax search:
• Married woman: up to 500 grams
• Unmarried woman: up to 250 grams
• Male (married or unmarried): up to 100 grams

Within these limits, no documentation is needed. Amounts above these limits are not automatically illegal - but may attract questions about the source.

What If the Gold Exceeds the CBDT Limits?

Excess gold is not automatically a crime. However, if queried by an income tax officer:
• Acceptable explanations: family inheritance, gifts over many years, agricultural income, pre-KYC era purchases
• If you cannot explain the source: may be treated as unexplained income, taxed at 60%+ under Section 69

For most families selling ancestral jewellery: the amount is typically within limits, and a reasonable family inheritance narrative is generally accepted.

Can You Sell Found Gold at Attica Gold?

Yes. Documents needed: Aadhaar + PAN (if sale > ₹2L). No ownership proof or purchase bill required.

The sale receipt itself helps regularise the position - proceeds go to your bank account as declared income.

Capital Gains on Old Found Gold

If purchase date and price unknown:
• Use FMV on 1 April 2001 as cost basis
• Holding period assumed 24+ months (if any reasonable evidence of age exists)
• 12.5% LTCG applies on the gain

A chartered accountant can help determine the appropriate tax treatment.

Yes. Aadhaar and PAN (if applicable) are sufficient. No purchase bill needed.

How much gold can I legally keep at home without documents?

CBDT: married women 500g, unmarried women 250g, men 100g.

What if my gold exceeds the CBDT limits?

You can still sell it, but have a credible source explanation ready if queried.

Does selling found gold make it declared income?

Yes - sale proceeds go to your bank account and are part of your income for that year.

What documents help prove the source of old gold?

Family photos, old purchase receipts, wills/inheritance documents, gift letters.

Is keeping found gold illegal?

Not if within CBDT limits or with a reasonable source explanation. It is a declaration/tax compliance issue, not a possession crime.
